Responsibilities of the County Attorney

Welcome! As of January 1, 1993, I have had the privilege of serving as the County Attorney of Johnson County. The County Attorney is responsible for prosecuting adults charged with misdemeanor criminal offenses such as family violence assault, driving while intoxicated and theft; prosecuting juveniles charged with misdemeanor and felony criminal offenses; representing the Texas Department of Family and Protective Services (also known as Child Protective Services) in child welfare cases protecting the rights of abused and neglected children; representing victims of family violence who seek a protective order as provided by the Texas Family Code; representing applicants who apply through Johnson County Mental Health and Mental Retardation (MHMR) for mental health treatment at a hospital; and advising the Commissioners Court and other elected officials and department heads on legal matters.

Prosecuting adult misdemeanor criminal cases involves representing the State of Texas in the County Courts at Law at arraignment hearings, pre-trial hearings, non-jury trials, jury trials, and motion to revoke community supervision hearings while prosecuting juvenile cases involves representing the State of Texas in the County Courts at Law at detention hearings, adjudication hearings, disposition hearings and motions to modify. And should an adult or juvenile appeal his conviction, the County Attorney's Office continues to represent the State of Texas in the appeal which may involve appearing before the Tenth Court of Appeals in Waco or the Court of Criminal Appeals in Austin.

During my tenure as County Attorney, Johnson County's population has grown and along with growth has come increased challenges in meeting the demands of the duties and responsibilities of the County Attorney's Office. We have experienced a steady increase in the number of criminal cases as well as the Child Protective Service cases being filed in recent years. The Johnson County Commissioners Court has increased the funding for this office to meet the growing case loads. This office currently has eleven assistant county attorneys, an office administrator, ten support staff, and two investigator/liaison officers.
